Code of Ethics




The National Auto Auction Association is composed of members who are entrusted with the sale of their automobiles and by buyers who use the facilities for the acquisition of vehicles to be resold by them to the public. In order to carry out the trust so imposed, the Association, of which this firm is a member, has adopted this code of ethics.

  1. We will be fair to both sellers and buyers, and will give complete service, recognizing that both are our customers.
  2. We will protect the owner's interest as we would our own.
  3. We will be honest and ethical in all of our dealings with customers and we will maintain specific documentation that directly supports the actual bid sale price and all of the administrative and operational fees that are charged.
  4. We will create an atmosphere at our place of business, which will inspire confidence in ourselves and auto auctions generally.
  5. WE will do nothing to bring disrepute to the auto auction business.
  6. We will expose or halt any scheme designed to devise or defraud sellers or buyers or other automobile auctions.
  7. We will expose or halt any scheme designed to deceive or defraud any party that may be responsible for a deficit resulting from the sale of any vehicle or product that is sold at or auctions.
  8. We will try to keep abreast of business conditions and to keep informed in all laws and legislative matters affecting our business and that of our customers in order to give intelligent advise and effective service.
  9. We will do every thing we can to maintain the system of free enterprise.
  10. We will comply with national, state and local laws and rules that regulate the conduct of the automobile auction business.

Sudbury Auto Auction General Policies

  1. Only those registered under the Ontario Motor Vehicle Dealers Act and their licensed representatives will be permitted to carry out business transactions at this auction, subsequent to approval by SAA.
  2. Please Note: It is the responsibility of the dealer principal to notify the auction of any changes effecting licensing, banking or personal changes. This must be up to date and accurate at all times.
  3. Yard dealing is, and will always be considered as dealing in bad faith. All transactions must be processed through the auction. Dealers found to be selling vehicles to avoid fees will have their auction privileges revoked. All NAAA member auctions will be notified which may result in suspended privileges.
  4. Retail buyers are at no time allowed on the auction property. Any dealer violating this rule, may result in lose of auction privileges. All authorized buyers and sellers are required to register with the auction on sale day and to wear photo identification provided by the auction. Unauthorized people are restricted to the lounge area and are not permitted to enter the auction area at any time during the auction sale.
  5. All vehicles must be paid in full on auction day. There will be no exceptions to this rule. No personal cheque will be accepted. No vehicle will be allowed to leave the auction premises before the auction has received payment in full and has issued a gate pass.
  6. The auction will not be responsible regarding the model year of any machinery or recreational vehicles such as, snowmobiles, ATV, boat & motor, golf carts or rebuilt or reconstructed vehicles. Buyer must be satisfied and clear as to what he/she is bidding on.
  7. The auction acts only as an agent between buyers and sellers. It is the seller that represents the vehicles being sold.
  8. The seller guarantee's that he/she is the owner of the vehicle(s) and represents that he/she has clear title and the vehicle(s) are clear of all lien's and encumbrances.
  9. Any guarantees, promises or others made between seller and buyer must appear in writing on the sale contract in order to become part of the contract. The auction will not be involved in any verbal dispute or commitments. No vehicle will be sold without proper VIN. plate and markings.
  10. Vandalizing and tampering will not be tolerated. Any dealer caught tampering with; stealing from or vandalizing any vehicle will be punished to the fullest extent of the law.
  11. All dealers are responsible for insurance coverage guarding against theft, fire, and damage. The auction will not be responsible for vehicles damaged or other, while on auction property.
  12. All vehicles are subject to inspection by police or ICPB.
  13. Policies are subject to change without notice.



SUDBURY AUTO AUCTION ARBITRATION POLICIES
NATIONAL AUTO AUCTION ASSOCIATION CANADIAN MEMBER POLICIES.
Sudbury Auto Auction arbitration policies are a service provided by this auction for the protection of both Buyers and Sellers. A Seller will build confidence in its product and credibility with Buyers by disclosing all material facts about the structural and mechanical quality of the vehicle offered for sale. A Seller who consigns a vehicle for sale at a participating Canadian NAAA member auction (the "Auction") is required to declare the information listed below. The list is not intended to be exhaustive. As vehicles and our industry change, the disclosure obligations required of Sellers may similarly change. Accordingly, the Auction reserves the right to consider other information not specifically listed below.
The seller is responsible for all declarations made at the auction block. Any guarantees, promises or others made between seller and buyer must appear in writing in order to become part of the contract.

DECLARATION EXPLANATION ARBITRATION PERIOD
1. ABS Defective The seller must disclose if the anti-lock braking system is not operational (is equipped). Arbitration is only available for repairs over $500.00.Regular
2. Accident Repair
$3000.00.
The Seller must declare a vehicle to be Accident Repaired if a vehicle history report (e.g. Car Proof, Auto Check, CARFAX, and Lease Return Questionnaire) or other industry accepted information source indicates repair for single incident damage of $3000 or more.

If the dollar value of the accident is known, it must be declared.

If the seller believes that a vehicle history report is incorrect, it is the Seller's obligation to get the report corrected within the arbitration period or risk having the sale cancelled.

3. Adjacent Panels Replaced The Seller must declare if two or more adjacent panels (excluding bumper panels) have been replaced on a vehicle.

Please note: if the panels were replaced due to an accident, depending on the cost of repairs, it may also be necessary for the Seller to make the accident repair declaration.

4. Air bags missing/defective The Seller must disclose if the vehicle's airbags are missing or not operational Regular
5. Alternate fuel or conversion The seller must disclose if the vehicle uses propane or natural gas, or at any time had a propane or natural gas fuel system. Regular
6. Excessive Rust The Seller must disclose if the vehicle suffers from excessive rust. Rust is considered to be excessive when the location or quantity of the rust affects the structural integrity of the vehicle, e.g. the frame of any structural component is perforated by rust. Regular
7. Fire Damage The Seller must disclose if the vehicle has been damaged by fireExtended
8. Flood Damage The Seller must declare a vehicle as Flood Damaged when:
1 - water or other liquid has penetrated the vehicle to the level of the floor boards or higher; or
2 - if any of the following components have been damaged due to immersion:
Front or rear lighting or wiring harnesses/ Engine and its major components / Transmission and differential / Dash instrument panel and wiring / Passenger seat cushions / Power seat or window motor / Major sound system components.

9. Grey Market The Seller must declare if the vehicle was ever registered in a country other than the United States or Canada or manufactured not in compliance with North American standards. All Grey market vehicles offered for sale must include a Car Proof Verified vehicle history report, or equivalent.Regular
10. Incident Report (optional) If the Seller has a third party vehicle history report (e.g. Car Proof, AutoChek, CARFAX) indicating accident repair of under $3000 it may be declared as an Incident Report at the option of the Seller; however, no arbitration is available.N/A
11. Incorrect Vehicle Marking The Seller must disclose if any logo, badge, decal, emblem, ornament or similar markings of the vehicle do not match the make, model or series of the vehicle. Regular
12. Irreparable Regardless of whether the title has been branded, the Seller must disclose if the vehicle is not capable of being repaired for roadworthy operation and may only be used for parts of scrap. Irreparable vehicles are assumed to also be Total Loss vehicles and thus the Total Loss declaration does not need to be made. Extended
13. Km. 3000 km. If the odometer reading is accurate, the Sell must disclose the distance the vehicle has traveled as indicated on the odometer. Minor odometer discrepancies of 3000km or 5% (whichever is less) are not subject to arbitration. Extended

The Seller must disclose if a major component of the vehicle is defective or not operational and the component would cost over $500.00 (on a non-cumulative basis) to repair or replace in accordance with standard Mitchell warranty rates.

Major components include:
Engine / Transmission / Power train / Sub-frame / Suspension / Computer equipment / Fuel operation system / Electrical system / Emissions system.

The following items are not subject to arbitration:
Upholstery /Glass / Hail damage / Tires / Visible body damage

If the province of the last registration (or equivalent) to a retail customer is different than the jurisdiction from which the vehicle is currently being sold, the vehicle must be declared an out of province vehicle and the Seller must identify the last province in which the vehicle was registered (or equivalent) to a retail customer.
For vehicles sold in Ontario only:
A vehicle remains an out of province vehicle and must be so declared, if it was previously registered (or equivalent) to retail customer in another province and has been registered in Ontario for less than 7 consecutive years.
The seller must declare all of the provinces in which the vehicle was previously registered.

  1. Sellers Disclosure Requirements - Seller must disclose structural damage, repairs or replacements as outlined in this policy prior to selling a vehicle at auction. The recommended declarations are:
    • Structural Damage - The vehicle has structural damage and/or repairs and will not be subject to arbitration under this policy.
    • Certified Structural Repairs - The vehicle has sustained damage to a specifically identified structural component, which has been repaired, and the vehicle has been certified to be within the Used Vehicle Measurement Standard (UVMS). The vehicle, if properly announced, may be arbitrated only for improper repair of the designated area, existing damage or repairs to other areas, or failure to be within the UVMS (see par. 3).
    • Structural Alteration - The vehicle has an altered frame or unibody as specifically announced. The vehicle can be arbitrated only for damage or repairs to structural components other than those disclosed or in the event of improper alteration. Such a disclosure should be made for the following alterations, unless they are clearly obvious by the appearance of the vehicle.
    • Frame lengthened or shortened.
    • Suspension altered.
    • After market accessories installed/removed.
  2. Seller's Disclosure Not Required - No declaration will be required for existing insignificant damage or repair thereof. Insignificant damage is defined as:
    • Damage due to transport tie-down if less than 1", improper jacking or lifting or contact with parking abutments and/or road debris, provided that the vehicle is within the UVMS.
  3. Measurement of Vehicle - Selling auction will, at its discretion, have a vehicle measured at a facility of its choice. Prior to measurement a vehicle must first visually indicate a physical condition to warrant the measurement. Purchaser will agree to pay for this measurement if the vehicle is within the UVMS. Seller will be responsible for charges if the vehicle is found to be beyond the UVMS.
  4. Used Vehicle Measurement Standard - For purposes of arbitration under this policy the Used Vehicle Measurement Standard (UVMS) specifications are:
    • The vehicle will measure to a total tolerance of no more than +/- 8mm of published specifications in length, width and height at all master control points; and
    • Symmetrically (comparative measure from side to side and point to point) the length, width and height must measure to a tolerance of no more than 6mm. In each case the fender to door, door to door, and/or door to quarter panel gaps must indicate proper fit of the panels.
  5. Undisclosed Structural Damage or Repair - A vehicle may be arbitrated if it has undisclosed existing or repaired damage, which should have been disclosed under this policy, even though the vehicle is within the UVMS.
  6. Arbitration Period - Buyer must arbitrate improperly disclosed structural damage within 7 calendar days from date of purchase. The vehicle must be returned to the selling auction, or to an auction or facility designated by the auction within 7 calendar days of arbitration.
  7. Buyer's Reimbursement by Seller - In the event of improperly disclosed structural damage the Seller will be responsible to reimburse the Buyer for:
    • The actual price of the vehicle,
    • The Buyer's fee
    • Measurement and arbitration fees incurred at the auction, and
    • Reasonable transportation costs actually incurred transporting the vehicle to and from the Buyer's dealership.
    • Post-sale inspection fees remain the responsibility of the buyer.
This policy is a recommendation only. Its adoption by NAAA members is strictly optional.
Structural Damage Policy Clarifying Points
  1. Towing packages do not require announcement.
  2. Access holes for Paintless Dent Removal do not require announcement if ¼" or smaller. Many PDR access holes in very close proximity or access holes greater than ¼" need to be assessed on a case by case basis. Has the structural integrity of the vehicle been compromised?
  3. Damaged or replaced core supports are not subject to arbitration under this policy. Damage to the apron on a unibody in the area where the core support attaches may be subject to arbitration if significant damage or distortion has occurred. Will the unibody measure within the UVMS?
  4. Welded exhaust hangers are not subject to arbitration under this policy.
  5. Floor/trunk panels dented to a depth of 2" or more constitute structural damage and must be disclosed. Tears in these panels that separate welds, rivets or other bonds also must be disclosed.
  6. Roofs that have been re-skinned do not require disclosure. Roofs that have been cut off or removed and repaired must be disclosed.
  7. Quarter panel, rocker panel, floor pan, etc. damage to a ladder or perimeter frame vehicle is not structural damage a does not require disclosure.

Welcome to Sudbury Auto Auction Live Lane webcast auctions. We hope you enjoy your on line bidding experience. Our goal is to assist our customers in making online buying and selling an enjoyable and positive experience. Please read and understand the policy before purchasing vehicles on line. The policy is designed so both buyers and sellers fully understand the on line process. If you should have any questions or concerns regarding the policy, please contact an auction representative. Changes to this policy may be made at any time.
Who can use LIVE LANE
  1. Only licensed motor vehicle dealers approved by and registered with Sudbury Auto Auction Ltd. are permitted to buy and sell on LIVE LANE. Please ensure that your dealer information is kept up to date and the auction is notified of any dealer information changes.
  2. You may register or make registration changes under the home page heading BECOME A CLIENT.
  3. Complete all the fields in this application form in order to become a new consignor or purchaser. Upon acceptance of your registration an auction representative will contact you with a user name and password. Once issued, the dealer accepts complete responsibility for safe guarding the confidentiality of this information and agrees to accept full responsibility for any transactions conducted through their LIVE LANE account.
You're obligations as a LIVE LANE subscriber
Live Lane is a means of buying and selling USED vehicles. Please remember, used vehicle have defects due to normal wear and tear. Keep this fact in mind when bidding.

As a buyer you are expected to review all details pertaining to the vehicle you are bidding on. The vehicle details, description, a list of options and declarations are available when you open the individual vehicle window.

You will be deemed to have bid when you click on the BID icon. Once you bid it cannot be withdrawn. Please be sure of what you are bidding on. All bids register on the auction block lane monitor and are recorded electronically by the LIVE LANE server. Internet and auction floor bids will appear on the auction lane monitor for all to see. Internet bidder's registration numbers and city will also appear on the lane monitor. The sale results for all vehicles will be posted under the LIST icon on the main bidding page. This list will indicate which vehicles have or have not sold the amount as well as the internet or floor buyer. Please note that most vehicles are subject to a reserve bid and will only be sold when the reserve is met or surpassed.
LIVE LANE Arbitration Policy
The standard auction arbitration policies will apply to all LIVE LANE purchases as posted. Please inspect your purchases immediately upon receiving them. The buyer or buyers' agent (transporter or driver) should make note of any obvious damage prior to removing the vehicle from the auction The auction and the seller will not be responsible for any obvious damage not reported to the auction or identified on the condition report once the vehicle is removed from the auction facility.

It is the purchaser's responsibility to report any arbitration to the auction within 1 business day after receiving the vehicle. Please pay particular attention to the lights the vehicle is being sold under. You may arbitrate a vehicle if there is a major material difference from the description provided on the LIVE LANE site such as vehicle features or color. You may arbitrate a vehicle if there are undisclosed damages greater than $500.00. (Remember, you are purchasing used vehicles) Please note that RED LIGHT vehicle are rougher vehicles. They may have had previous paint and body work as well as other repairs)
LIVE LANE Post Sale Inspections
We highly recommend a post sale inspection be conducted. A $25.00 inspection is available. Your vehicle will be hoisted to carry out an under body inspection and the vehicle will be inspected to identifying any major mechanical problems that may result in arbitration. If you chose to waive this inspection the auction will not be held responsible for any shipping costs pertaining to the return of the vehicle to our facility. An inspection request sheet will be faxed to you with your bill of sale requesting whether you wish to have the inspection completed. Please complete and return this sheet immediately.
Light System
GREEN LIGHT "RIDE & DRIVE"
The green light signals that the vehicle is guaranteed under the conditions outlined in the arbitration policies, with the exception of specific announcements made prior to the sale.

YELLOW LIGHT "ANNOUNCEMENTS"
This light is an indication to the buyer that the auctioneer or selling representative has made announcements that qualify / clarify the condition or equipment and limit arbitration of this vehicle.

RED LIGHT "AS IS"
Vehicles selling under the red light will only qualify for arbitration under the rules outlined in the arbitration policies.
